These Terms of Service govern purchases and use of dilverse.in and Dilverse personalized creative services. By placing an order, you agree to these Terms, our Privacy Policy, and our Refund & Cancellation Policy.
1. Eligibility and order accuracy
You must provide accurate contact and personalization information. You are responsible for reviewing names, spellings, pronunciation guidance, dates and memories before submitting your order.
2. Nature of the service
Dilverse provides custom digital creative services. The final song is an original interpretation of the brief and may not reproduce every sentence exactly. Melody, arrangement, vocal interpretation, rhyme, structure and production choices involve creative judgment.
3. Customer-submitted content
You represent that you have the right to provide the names, stories, text, images or other material submitted with your order and that your submission does not unlawfully infringe another person’s rights. Do not submit unlawful, abusive, defamatory or intentionally harmful content.
4. Payments
Prices are displayed in Indian Rupees unless stated otherwise. Payment is processed through the payment method offered at checkout. An order is treated as paid only after successful payment confirmation. Dilverse does not intentionally store full card numbers, CVV, UPI PINs or online banking credentials.
5. Delivery
Orders are digital and are delivered electronically. Estimated timelines are described in our Shipping & Delivery Policy. Delivery estimates begin after successful payment and receipt of a sufficiently complete brief.
6. Revisions
Revision entitlement depends on the package purchased and the inclusions shown at the time of order. A revision means a reasonable correction within the original brief, not a completely new concept, story, recipient, genre or song unless separately agreed.
7. Refunds and cancellations
Because each order is personalized, refund eligibility is limited once production begins. The specific rules and timelines are in our Refund & Cancellation Policy, which forms part of these Terms.
8. Intellectual property and permitted use
After full payment, the customer receives a perpetual, non-exclusive licence to use the delivered song and included creative files for personal gifting and personal social-media sharing. Unless a package or written agreement expressly grants commercial rights or copyright ownership, Dilverse retains rights in its production workflow, templates, brand assets and underlying creative/production materials. Commercial advertising, resale, sublicensing or claiming exclusive ownership requires prior written permission.
9. Third-party platforms
Delivery, payments, hosting, messaging and advertising may depend on third-party services. We are not responsible for outages or policy changes outside our reasonable control, but we will make reasonable efforts to complete paid orders.
10. No guarantee of a particular emotional reaction
We aim to create meaningful personalized gifts, but individual taste and emotional response are subjective. We do not guarantee that a recipient will react in a particular way.
11. Limitation of liability
To the maximum extent permitted by applicable law, Dilverse is not liable for indirect, incidental or consequential loss arising from use of the service. Nothing in these Terms excludes rights or remedies that cannot legally be excluded.
12. Governing law and disputes
These Terms are governed by applicable laws of India. Subject to mandatory consumer rights and applicable law, disputes will be subject to the courts having jurisdiction in Delhi, India.
